Filing through an attorney

A signed Form TM-48 authorises the trademark agent or attorney to file and correspond on your behalf.

Frequently asked questions

Is a logo required to register a trademark?

No. You can register a word mark without any logo, which protects the name in any font or style. A logo is only needed if you want to protect the design as a device or composite mark.

What is Form TM-48?

TM-48 is the authorisation that allows a registered trademark agent or advocate to file and handle the application for the applicant. It is signed by the applicant and uploaded with the application.

How can I prove prior use of my brand?

Dated invoices, marketing materials, website screenshots, packaging photos and sales records showing the mark are commonly used. They support a user affidavit stating the date of first use.

Do I need Udyam registration for the lower trademark fee?

To pay the reduced fee as a small enterprise, applicants generally submit an Udyam registration certificate. Individuals and DPIIT-recognised startups also qualify for the lower fee.
