The short answer

After registration, use the R symbol on registered goods or services, use the mark consistently, renew every 10 years with Form TM-R, record changes in ownership or address, monitor the Trade Marks Journal for conflicting marks, and act against infringers. A mark not used for five years can be removed for non-use.

Use the mark correctly

  • Use R only for registered goods or services
  • Keep the mark consistent with the registration
  • Keep dated evidence of use

Renewal

File Form TM-R within six months before expiry. Late renewal is possible within the grace period with a surcharge, and restoration is possible within limits after removal.

Watching and opposing

Monitor the Trade Marks Journal for similar marks and oppose within four months of publication to prevent conflicting registrations.
